Terms of Service

1. Description of Service

Web Gerek is a SaaS (Software as a Service) platform that enables small and medium-sized businesses to create websites without coding. The Platform offers both free and paid plans.

2. Account Creation

• A valid email address is required to create an account.
• You are responsible for the security of your account credentials.
• Sharing your account with others is prohibited.
• Individuals under 18 may not use the Platform.

3. Paid Plans and Payment

• Payment processing is managed through Freemius, Inc.
• Paid plans renew automatically on a monthly basis.
• Price changes are communicated at least 30 days in advance.
• For payment details, Freemius' Terms of Sale apply.

4. Acceptable Use

By using the Platform, you agree not to:

• Publish illegal, harmful, threatening, defamatory, or obscene content
• Publish content that infringes third-party intellectual property rights
• Host malware, viruses, or harmful code
• Overload the Platform infrastructure in a damaging way
• Use the Platform for spam, phishing, or fraud
• Attempt to bypass the Platform's security measures
• Gain unauthorized access to other user accounts

The following types of content are strictly prohibited:

• Child abuse, pedophilia, or any content targeting minors
• Pornographic, sexually explicit, or adult content
• Hate speech or content that discriminates based on race, ethnicity, religion, gender, sexual orientation, or disability
• Terrorist propaganda, incitement to violence, or radicalization content
• Sale or promotion of illegal goods or services (drugs, weapons, counterfeit documents, etc.)
• Unauthorized sharing of personal information (doxxing) or content that violates others' privacy
• Sites created to impersonate brands, organizations, or individuals
• Gambling, betting, or unlawful financial activities
• Content that encourages suicide or self-harm

5. Content and Intellectual Property

• Your content: Website content you create on the Platform (text, images, logos, etc.) belongs to you.
• Platform rights: The design, code, templates, and infrastructure of the Web Gerek Platform are owned by Efe Gerek.
• Templates: Templates used under any plan are licensed to you; you do not own the templates themselves.
• Web Gerek branding: Sites created on the free plan display a "Made with Web Gerek" badge.

6. Service Level

• We do not guarantee 100% uninterrupted operation of the Platform.
• Temporary outages may occur due to maintenance, updates, or technical issues.
• Scheduled maintenance is announced in advance when possible.

7. Content Removal, Suspension, and Termination

Web Gerek reserves the right, at its sole discretion and without prior notice, to:

• Immediately remove sites and content that violate these Terms or applicable laws
• Permanently delete projects hosting inappropriate, harmful, or illegal content
• Temporarily or permanently suspend or terminate accounts that violate these Terms
• Remove content in response to legal notices or court orders
• Investigate and take action on third-party complaints

Your account may be suspended or terminated without prior warning if:

• You publish any type of prohibited content listed in Section 4
• You use the Platform for illegal activities
• You attempt to disrupt the Platform's operation or compromise its security
• You fail to meet your payment obligations
• Repeated violations or abuse

When your account is terminated or your site is removed, all associated websites and content (subdomain, files, data) are deleted. You are solely responsible for regularly backing up your content. Web Gerek is not liable to pay any compensation for removed or deleted content.

When illegal content is detected, we reserve the right to notify competent authorities and cooperate with legal processes.

8. Limitation of Liability

The Platform is provided "as-is". To the maximum extent permitted by law:

• We are not liable for direct or indirect damages arising from your use of the Platform.
• We are not responsible for third-party content published on the Platform.
• We are not liable for data loss; we recommend regularly backing up your content.

In any case, our total liability is limited to the amount you paid us in the last 12 months.

9. Third-Party Services

The Platform uses the following third-party services:

• Clerk: Authentication and login management
• Supabase: Database and file storage
• Cloudflare: Content delivery and hosting
• Freemius: Payment management

These services are governed by their own terms of service and privacy policies.

10. Changes

We may modify these Terms with prior notice. Significant changes will be communicated by email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Istanbul courts and enforcement offices have jurisdiction over any disputes.
